I did forget that. Do you remember any of these racks being in his possession? I would think that if they were it wouldn’t such a big surprise to many of us as Davis would have gotten them out there, and more would remember it. That’s why I’m thinking that my memory is off a little.

For what its worth, David had six daughters, as well as one step-daughter.
They all live in Maine except for Michelle (who lives in Ohio) and Tina, his step-daughter that lives in Texas.
So, I am still not sure where a CT connection comes into play.
I’ll take one of each size by the way.. 😉

As a mouse walking amongst elephants, I will say. The OP was from a standing member and said he had 75. He made it sound like he purchased them, from someone just wanting them out of a garage. Since none of you Wise old sages had any issues with the logo, and started discussing where they might have came from, I definitely wanted one. Purchasing and shipping is the conundrum.
I assumed Buck made two and wanted to see how many he could sell before he made more.
I stand by my order. Just need the info.

Sorry my friend your assumption is wrong. I didn’t make any and have stated I bought 75 of them at auction and that is the truth. They are sitting in 4 boxes on 2 pallets in my warehouse. I did not post here with any intent to sell them and inquired solely because I wanted to know their history. When were they made, were they promotional items, were they for sale? I called the WACA office yesterday and spoke with Heather, sent her the pics and she is checking with a couple members and promised to get back with me next week. I had also called the daughter of the WACA member who passed away and previously owned these to inquire on her father’s name to see if any of you knew him. She just texted me and said his name was Bert Jolicoeur! Hopefully, someone remembers him. She also advised she believes he had them custom made and is going to look through his old papers to see if she can find the shop that made them for him. If true, then that explains why no one can recall these ever being offered. The question then becomes did he get approval from WACA and Winchester to use their names? My gut says no but I will wait to see what Heather finds out and report back.

I respect all you old timers. These gun racks are really neat. I knew I didn’t know what I was talking about. I was more just asking questions with my assumption. I didn’t mean to offend buck if I did. I am definitely buying one if buck offers them for sale. As I said. I wouldn’t care if they were new. That was all I meant. I wonder if he had them made and then Winchesters lawyers had an issue.

I doubt that Olin Industries was ever aware of them, and am relatively certain that WACA was unaware of them as well.

My speculation is that none made it into the hands of any collectors. It sounds like there was an original production run of 75, and that run stayed together, as it sits now. Of course, now, fellow collectors very much want that run to no longer stay together

There is a Small “TM” after the Winchester logo on the top middle but nothing on the WACA logo. Looking at WACA’s website I don’t see anywhere it shows a treademark?

Great timing for my lawyer to chime in! Zeb, can you give me a written “Formal Legal” letter of opinion stating that I can legally sell items that were produced using Winchester and WACA’s logo’s without their authorization? Rhetorical I know 😀
Seriously, I am awaiting a reply from Heather as I think it best to let her validate whether these were ever approved or not. If not, I feel WACA itself has to approve the fate of these Gun Racks. I promise I’ll keep you guys updated!

Zebulon is long retired and cannot opine on anything more complicated than what he had for breakfast.
Surely there are younger members of the Bar who are also WACA members, who would know something about the law of intellectual property.
Speaking only for myself, I would cheerfully buy one of those racks and pay a reasonable sum for it relying on Rule 101- you can’t get blood out of a turnip.

From what I recall of WACA’s dealings (and others) with the modern company often referred to as Winchester I’m thinking it may do to consider if they would approve of the use of their trademark or approved the use of it when these racks or decals were manufactured. They have the right to control the use of their trademarks and apparently they’re not afraid to exercise it.

I wonder if this was the original glitch – that was never resolved – which would explain why they just sat in storage status for all these years.

Well, true but there is a pseudo-ancient Maxim of Equity invented by one of my old classmates, now lamentably dead, who was trying to answer a question given on our Bar Examination, “Name 7 Maxims of Equity”. He racked his brain but could only come up with 6. Because time was running out, he threw caution to the wind and in desperation wrote,
“7. Equity will not flog a dead horse.”
He scored high enough to pass the exam but was curious to see how the Examiners had scored his answer to that particular question. When the old exam papers became available, he looked his up and saw his Examiner had marked his answer at 100% — and with a red exclamation point in the margin next to the “7” .
I have a feeling Olin’s Assistant General Counsel for litigation, if confronted with the existence of these 75 old racks and whether to seek an injunction and damages, would very likely invoke the Seventh Maxim, particularly since the market for the racks consists of WACA members whom Olin generously favors anyway. And nobody is contemplating futher production without a license.
