That’s exactly what I mean and why it may be best to let sleeping dogs lie, even though 127 years ago was an awfully long time ago.

An ex felon in Canada is not likely to have a valid PAL but possible someone could potentially slip through the cracks or received a pardon for non weapon or domestic violence offences. Anyway I guess the same thing could happen with a m1866 or m1885, but very uncommon and unlikely. Almost all crimes are committed by those with no PAL and illegally acquired or stolen firearms. We did unfortunately have a soldier standing memorial that was gun downed by some ideological screw ball with a 30-30 lever in Ottawa a few yrs back who eventually met his maker but once again incidents with antique or lever guns are not common.
In Canada all firearm owners, buyers, sellers and hunters are required to have a valid and current PAL(Possession/Acquisition License) unless it’s antique status. The only Winchesters that have antique status are model 1866 rimfire and model 1885 single shot above 32-40 calibers with proof age(18), otherwise all sellers are required by law to confirm the buyer has a valid PAL before shipping or a face to face transaction. The same holds true for ammunition.

Yes, I do know how an antique firearm came to be defined according to the GCA of 1968. For those who don’t know, I can elaborate, if desired.
The problem with trying to get this revised, and bringing this to the attention of your congressman, is that it’s a double edged sword and if legislation were brought forth to extend it to pre 1940 (or pre 1950, etc), the anti 2A folks would be made aware of the antique firearms provisions and deem that unacceptable, requiring an FFL for all firearms irrespective of date of manufacture.
It’s interesting how the opposite is the Curio and Relic license with the rolling 50 year status. Every new rifle, shotgun and handgun sitting on the shelves that I browsed through as a high school senior now has C&R status.

I think in all reality, the ATF, needs to re visit this, and possibly address the issues as stated here, and maybe come up with a resolve, as was previously stated.
Otherwise this will keep happening and going on for a long while!
Then again, maybe we should be careful what we wish for!
