There’s a fellow in Wyoming that tells me that there are no laws that preclude him from shipping any gun he chooses directly to anyone he wants to in the USA. While I don’t think his interpretation is correct, I think he should do what he wants. It helps keep the ATF busier and they have less time to focus on the rest of the collector world.
On the post’s original subject, I saw this gun sell on Gunbroker and then immediately show up on Gunsinternational. I really like these very late guns in the rarer calibers.

The last ones I know of are 1936 vintage, like this rifle, and about 50,000 rifles earlier.

Winchester announced in the January 1938 Salesman catalog that the 32-40 and 38-55 calibers were officially discontinued. At the same time they announced that the Model 94 Sporting Rifle and Model 55 Rifle were discontinued, and that only the Model 94 Carbine and Model 64 Rifle were available.
Serial number 1157117 (Merz’s gun) was manufactured in mid December 1937. If it was not the last one made in 38-55, it was very near it. That stated, I have found a small number (less than a handful) that were made after January 1938. In each case, they appeared to be parts clean guns.
So, how can Leroy Merz claim he has both one of the last .38-55’s produced, and yet it is an antique (pre-1899)????
Not sure where you got the idea it was made pre-1899. As mentioned above, it was made in 1937.
Merz has it listed under the “antique” category which was probably just a simple error on his part.

No where is the description of the firearm does Merz mention the firearm is a antique. So I think you guys are blowing this one out of the water quite a bit. And as long as Mr. Merz has been in business I imagine he knows the difference between an Antique or otherwise.

I don’t think everyone will ever agree on this topic, whether its the Madis vs. PR dates or interpreting the antique firearm laws or codes. Ultimately its not much different than speeding on the highway. I really don’t care how fast you are going if you are driving the car and I’m the passenger (unless we hit 88mph and end up in Hokies “twilight zone). Yet when I am driving it becomes my responsibility to follow the law as I am the one at risk to get the ticket.
I suppose we can make our own interpretations and take care of our own affairs as we see fit. The consequences will eventually catch up with the folks that deserve them, like the Tulsa gun show thieves.

This Should Be a Elementary Answer (not grade school, high school or college) Just a Relevant Answer, to a Elementary Question.
I would have to Revert to, The Bible, The New Testament, “The Winchester Model 94, The First 100 Years”. By a Renowned Author, Who is a WACA Member (BOBR94) and Makes an Appearance Here Once in a While, to Offer His Words of Wisdom Regarding The Winchester Model 94 and It’s Variants.
I Will Reference, Chapter 2 (Barrels), Verse 3 (Details), Page 65. Pre 64, Model 94 Rifle, 38-55 Caliber, Serial # 2,137,xxx. Built in the, mid 1950’s
Al, I might not be 100% correct on this, but with all My reference material available to me, that I have read. It is my opinion that this might be the Last, Pre 64 Model 94 made, in 38-55 caliber.
Oh by the way, you should get a copy of this book as it is full of information. If you favor the Winchester Model 94.

Just for the record i,m the seller of the Winchester 94 in 38/55 which was sold i thought and then appeared on Gunsinternational.the buyer informed me immediately after the auction that he was not going to be able to pay,one of those deals where he selling a gun to a friend and the deal fell through,so he did not have the funds
